Ease Back Into Regular Life.

Block your first day back, or at least the morning. Take no clients or find a sub for the store or restaurant. Give your body and your mind some time to close out from the time away and have time to get ready for your week ahead. Remember last conference ? this can snowball out of control quickly. Make small steps of progress. This isn?t something we do often, so creating and remembering a routine is helpful.

Anchoring yourself for just a few hours at the beginning of your first week back gives you miles more productivity that week. Or if you?re prone to getting sick when you wear yourself out, this time you?ll be healthier. Just as you change your watch as you enter a new time zone, use routines to re-enter real life again. Examples of that are: doing your weekly review, unpacking and getting laundry done right away, dining out your first night back.

This principle was known as the ?merger rule.? However, this rule has since been superseded, and is no longer in effect, provided the trust is properly drafted. Before one can really understand what the merger rule means, its important to define what a ?grantor,? ?trustee,? and ?beneficiary? are.

A grantor is the person who sets up a trust and ?grants? property into the trust. The trustee is the person who (as the name implies) is entrusted with the management of the assets placed into the trust. Finally, the beneficiary is the person who, not surprisingly, is entitled to receive the benefits of the trust.

Way back in 1909, in a legal case called Estate of Washburn, a judge laid out the rule that a trust that vested legal title (trusteeship) and equitable title (beneficiary status) in a single person was void. The reasoning behind this rule was that theres no point in a trust that accomplishes the same thing as owning the property as an individual.

In response to this ruling, statutes were adopted that created exceptions to the merger rule. Now, under California law, a trust is not void, even if the grantor, trustee, and beneficiary are the same person, as long as there are people designated in the trust document to serve as ?successor trustees? and ?remainder beneficiaries? once the original grantor has passed away. If there are people waiting in the wings to take over the trust once the settlers are gone, then the trust has a purpose-estate planning-that gives it a reason to exist. Thus, the merger rule doesnt apply.

The merger rule is so old, and the exceptions are so broad, that it practically never becomes an issue in modern trust practice. Its mostly just an interesting bit of legal trivia. As long as the grantors have designated people to step into their shoes as trustees and beneficiaries when the grantors pass away, the merger rule shouldnt have any effect on their trusts

New Delhi, May 30 (IANS) With voices of protest against black money and graft getting shriller, the government Monday announced a new agency that will probe all criminal matters that have financial implication, especially under the tax laws.

The new Directorate of Income Tax for Criminal Investigation, to be known in short as DCI, has been created within the Central Board of Direct Taxes (CBDT) in the Ministry of Finance with headquarters in the capital to be headed by a director general in the rank of chief commissioner of income tax.

The announcement comes a day after the government commissioned an in-depth and fresh study, engaging three top national level institutions, for estimation of unaccounted income and wealth held within and outside India.

There have been wide-ranging estimates of the amount of Indian black money stashed abroad ? from $500 billion to $1,400 billion.

A recent study by Global Financial Integrity has estimated the outflow of illicit money at $462 billion.

Addressing a recent conference of senior officers of the income tax department, Finance Minister Pranab Mukherjee had talked of forming a new agency to track financial crimes.

?The directorate will deal with tax crimes related to illegal activities. It will locate crimes or criminals by tracing the movement of money before, during and after a crime is committed,? Mukherjee had said.

The DCI?s scope of work would include collecting information about persons and transactions that are suspected to be involved in criminal activities and to investigate the source of such funds.

It would, among other things, also have the authority to issue show cause notices to suspects, file and pursue prosecution in court, execute witness protection programmes for shielding whistle blowers and to enter into agreements for sharing of information with any central or state agency in India.

It can also share information with external agencies, provided India is a signatory to such an international agreement.

Facing criticism from all sides and accused of protecting the corrupt, the government has recently announced a slew of measures to track black money and prosecute the criminals.

It recently constituted a committee chaired by the CBDT chief to suggest ways of strengthening anti-money laundering laws and recovering black money parked in overseas banks.
